Law No. 13/2010/QH12, published on November 23, 2010

Contractual arrangements: It outlines the legal framework for signing and implementing contracts related to hydrocarbon activities, including production-sharing contracts, joint venture contracts, and service contracts.

Environmental protection: The law mandates measures to prevent and mitigate environmental impacts associated with hydrocarbon activities, such as environmental impact assessments, waste management, and oil spill response plans.

Electricity Law

Law No. 28/2004/QH11, published on December 3, 2004

Purpose: The Electricity Law aims to regulate the generation, transmission, distribution, import, export, and use of electricity in Vietnam. It seeks to promote competition, attract investment, ensure reliable and affordable electricity supply, protect the rights and interests of consumers, and promote renewable energy development

Regulations– Market liberalization: The law outlines the legal framework for the liberalization of the electricity market in Vietnam, including the separation of electricity generation, transmission, and distribution activities, and the establishment of a competitive electricity market.

Licensing and permits: It sets forth requirements and procedures for obtaining licenses and permits for electricity generation, transmission, distribution, import, and export activities.

Renewable energy promotion: The law mandates targets and incentives for renewable energy development, including feed-in tariffs, priority dispatch, and preferential treatment for renewable energy projects.

Renewable Energy Development Law

Law No. 57/2019/QH14, published on November 26, 2019

Purpose: The Renewable Energy Development Law aims to promote the development and utilization of renewable energy sources in Vietnam. It sets forth targets, incentives, and policies to attract investment, accelerate renewable energy deployment, and contribute to sustainable development, energy security, and climate change mitigation.

Regulations– Feed-in tariffs: The law mandates feed-in tariffs for electricity generated from renewable energy sources, providing a stable and favorable pricing mechanism for renewable energy projects

Renewable energy targets: The law sets forth national targets for the share of renewable energy in the country's total energy consumption, providing a framework for renewable energy development planning and implementation.

Investment incentives: It provides various incentives for renewable energy projects, including tax exemptions, reduced land use fees, preferential loan rates, and other financial incentives to attract investment in renewable energy projects.

Energy Conservation Law
(Luật Tiết kiệm Năng lượng)

Law No. 50/2010/QH12, published on June 17, 2010

Purpose: The Energy Conservation Law aims to promote energy efficiency and conservation in Vietnam, reduce energy consumption, and contribute to sustainable development, energy security, and environmental protection.

Regulations– Energy efficiency standards and labeling: The law establishes energy efficiency standards for equipment, appliances, and buildings, and requires energy labeling to inform consumers about the energy performance of products.

Energy auditing and management: It mandates energy auditing and management for large energy-consuming facilities, including energy audits, energy management plans, and reporting of energy consumption data.

Energy performance contracts: The law encourages the use of energy performance contracts between energy users and energy service providers to improve energy efficiency and achieve energy savings.

Energy conservation in transportation: It sets forth measures to promote energy conservation in transportation, including fuel efficiency standards, emission reduction measures, and promotion of public transportation and non-motorized transportation.

Law on Environmental Protection

Law No. 55/2014/QH13, published on June 23, 2014

Purpose: The Law on Environmental Protection aims to protect and improve the environment in Vietnam, prevent and control environmental pollution, and promote sustainable development.

Regulations– Environmental impact assessment: The law mandates environmental impact assessments for projects and activities that may have significant environmental impacts, including energy projects such as power plants, refineries, and mining activities.

Environmental permits: The law requires businesses and individuals to obtain environmental permits for activities that may cause environmental pollution, including energy production, import, export, transportation, and development.

Environmental monitoring and reporting: It sets forth requirements for environmental monitoring and reporting by businesses and individuals engaged in energy activities, including regular monitoring of emissions, effluents, and waste, and reporting of environmental data to relevant authorities.

Law on Electricity
(Luật Điện)

Law No. 28/2004/QH11, published on November 3, 2004 (as amended by Law No. 37/2019/QH14, published on November 20, 2019)

Purpose: The Law on Electricity governs the production, import, export, transportation, distribution, and use of electricity in Vietnam, and aims to ensure efficient, reliable, and sustainable electricity supply for socio-economic development.

Regulations– Electricity market and competition: The law establishes the framework for a competitive electricity market in Vietnam, including provisions for generation, transmission, distribution, and retail activities, and the participation of private and foreign investors in the electricity sector.

Electricity planning and development: It sets forth the requirements for electricity planning and development, including national and provincial electricity plans, generation capacity planning, and renewable energy integration.

Electricity generation and distribution licenses: The law requires businesses to obtain licenses for electricity generation, distribution, and retail activities, and sets forth the procedures and requirements for obtaining and maintaining these licenses.

Tariff and pricing: It establishes the principles and procedures for electricity tariff and pricing, including cost-based pricing, market-based pricing, and tariffs for different customer groups, such as households, businesses, and industrial customers.

Law on Renewable Energy

Law No. 24/2020/QH14, published on November 17, 2020

Purpose: The Law on Renewable Energy regulates the development, production, and use of renewable energy sources in Vietnam, aiming to promote renewable energy development, diversify the energy mix, and reduce greenhouse gas emissions.

Regulations– Renewable energy development and promotion: The law sets forth measures to promote the development of renewable energy sources, including feed-in tariffs, incentives, and support mechanisms for renewable energy projects, as well as targets for renewable energy capacity in the national energy mix.

Renewable energy project development: It establishes requirements and procedures for developing and implementing renewable energy projects, including site selection, permits, licenses, and environmental impact assessments.

Grid connection and access for renewable energy: The law sets forth rules and procedures for connecting renewable energy projects to the national electricity grid, ensuring fair and non-discriminatory access to the grid for renewable energy producers.

Law on Energy Efficiency and Conservation

Law No. 50/2010/QH12, published on June 23, 2010

Purpose: The Law on Energy Efficiency and Conservation aims to promote energy efficiency and conservation in all sectors of the economy, including the energy sector, to reduce energy consumption, improve energy security, and mitigate environmental impacts.

Regulations– Energy efficiency standards and labeling: The law sets forth energy efficiency standards and labeling requirements for energy-consuming products, equipment, and appliances, including those used in the energy sector, to promote energy-efficient technologies and practices.

Energy auditing and management: It mandates energy auditing and management measures for businesses and organizations engaged in energy activities, including energy audits, energy management plans, and reporting of energy consumption and savings.

Energy performance contracts: The law encourages the use of energy performance contracts, which are agreements between energy consumers and service providers for implementing energy efficiency measures and sharing the resulting energy savings.

Law on Petroleum

Law No. 64/2014/QH13, published on November 26, 2014

Purpose: The Law on Petroleum governs the exploration, extraction, production, import, export, transportation, and sale of petroleum resources in Vietnam, aiming to ensure efficient and sustainable petroleum operations and resource management.

Regulations– Petroleum exploration and production: The law establishes requirements and procedures for petroleum exploration, production, and development, including licenses, contracts, and environmental impact assessments for petroleum projects.

Petroleum contracts and partnerships: It sets forth provisions for petroleum contracts and partnerships between the state and domestic or foreign investors, including terms and conditions for exploration, production, sharing of profits, and dispute resolution.

Law on Nuclear Energy

Law No. 58/2008/QH12, published on November 17, 2008

Purpose: The Law on Nuclear Energy regulates the development, management, and use of nuclear energy in Vietnam, aiming to ensure the safe and secure use of nuclear energy for peaceful purposes, such as electricity generation and other applications, while minimizing the risks of nuclear proliferation and environmental contamination.

Regulations– Nuclear energy development and management: The law sets forth requirements and procedures for the development and management of nuclear energy projects, including licensing, permits, and safety standards for nuclear facilities, as well as the establishment of a national nuclear energy agency to oversee and regulate nuclear energy activities.

Nuclear safety and security: It establishes measures for nuclear safety and security, including safety assessments, emergency preparedness and response, and physical protection of nuclear materials and facilities, in accordance with international nuclear safety and security standards.

Nuclear liability and compensation: The law sets forth provisions for nuclear liability and compensation in case of nuclear accidents or incidents, including liability limits, insurance requirements, and compensation mechanisms for victims of nuclear incidents.

Nuclear waste management: It establishes requirements and procedures for the management and disposal of nuclear waste, including storage, transportation, and disposal of radioactive waste in compliance with international standards and best practices.

Law on Energy

Law No. 50/2019/QH14, published on November 29, 2019

Purpose: The Law on Energy provides a comprehensive legal framework for the development and management of the energy sector in Vietnam, aiming to promote the efficient, sustainable, and secure development, utilization, and management of energy resources, as well as ensure energy security and environmental protection.

Regulations– Energy planning and policy: The law sets forth provisions for energy planning and policy, including the formulation of national energy development plans, the establishment of energy targets and policies, and the promotion of renewable energy, energy efficiency, and clean energy technologies.

Energy investment and development: It establishes procedures and requirements for energy investment and development, including the approval of energy projects, the issuance of licenses and permits for energy activities, and the promotion of investment in the energy sector.
